Car Title Nightmare!!!?

My brother bought a great used car which he later discovered the 'seller' sold on behalf of her son who bought it without a title from his ex girlfriend. Now that we have found the 'girlfriend' she is unresponsive in handling the title change. It remains in her name (and her liability) but she isn't cooperative in this effort.



Now, he's stuck with a working car, but no title available for him to place the auto in his name, or register, or get plates for it. Can he just sell it for parts without a title? It was only $500, but to him, it was transportation. How can he get out from under this? Any ideas????? anyone???Car Title Nightmare!!!?
Talk the the original seller if she (mother) doesn't give the money back, take legal action (small claims court). It will come up in court that the mother sold the car illegally.Car Title Nightmare!!!?
If he has a notarized bill of sale from the seller, then there may be some recourse for him in small claims court.

If you didn't have a clear title in the name of the seller at the time of sale, no money should have left your pocket. Period.



If you do a %26quot;lost title%26quot; they will send it to the title holder of record, not you.



Go back to whoever you %26quot;bought%26quot; it from, and demand a clear title or a refund.



The ex girlfriend can report her car stolen, show them the title in her name, and take the car back while you, as 'buyer', go to jail.



You could also point out the the title holder that anything that happens to the car is her responsibility until she signs it over, parking tickets, red light cameras, impound tows, and see if that will make her think about it.



So it is a bit a 2 edged sword you're dealing with.Car Title Nightmare!!!?
A pretty dumb move all in all not to insure the title was clear BEFORE handing over the money. Tell the mother who sold it you want the cash back and she can have the car. If she doesn't agree, tell her you will see her in court. You shouldn't even need a lawyer for this one.
